Kentsel d\u00f6n\u00fc\u015f\u00fcm projeleri \u00f6ncelikle b\u00fcy\u00fck kentlerimiz olmak \u00fczere acil ihtiya\u00e7t\u0131r. Kentsel d\u00f6n\u00fc\u015f\u00fcm politikalar\u0131 kentlilerin sa\u011fl\u0131kl\u0131, kaliteli ve dengeli bir \u00e7evrede ya\u015famalar\u0131n\u0131 ama\u00e7lamaktad\u0131r. \u00d6zellikle b\u00fcy\u00fck kentlerimiz a\u015f\u0131r\u0131 n\u00fcfus y\u0131\u011f\u0131lmalar\u0131 d\u00fczensiz ve \u00e7arp\u0131k yap\u0131la\u015fmalarla, yanl\u0131\u015f yer se\u00e7imleriyle kar\u015f\u0131 kar\u015f\u0131yad\u0131r. Bu tip olumsuzluklar\u0131n \u00f6n\u00fcne ge\u00e7mek ve mevcut olumsuzluklar\u0131 ortadan kald\u0131rmak daha sa\u011fl\u0131kl\u0131, d\u00fczenli ve ya\u015fanabilir kentler meydana getirmek i\u00e7in kentsel d\u00f6n\u00fc\u015f\u00fcm projeleri \u00fcretilmektedir.<\/p>\n<p style=\"font-weight: 400;\">Bilgi ve ileti\u015fim teknolojilerindeki geli\u015fmelerin etkisiyle de\u011fi\u015fen d\u00fcnyada kentler, kendilerini fiziksel s\u0131n\u0131rlar\u0131n\u0131n \u00f6tesinde d\u00fcnyaya anlatmak gere\u011fi duymaktad\u0131rlar. Bu do\u011frultuda, son y\u0131llarda \u00fclkemizde de d\u00fcnyada oldu\u011fu gibi \u201ckentsel d\u00f6n\u00fc\u015f\u00fcm\u201d ad\u0131 alt\u0131nda kentsel yenileme faaliyetleri olmaktad\u0131r. B\u00f6ylece, kentsel d\u00f6n\u00fc\u015f\u00fcm yap\u0131ld\u0131\u011f\u0131nda i\u015flevsiz alanlar yenilenmi\u015f, eski-yeni uyumu sa\u011flanm\u0131\u015f, plans\u0131z geli\u015fen kent par\u00e7alar\u0131 belli bir d\u00fczen i\u00e7erisinde kontrol alt\u0131na al\u0131n\u0131p yeniden olu\u015fturulmas\u0131 ama\u00e7lanmaktad\u0131r. Kentlerde sorunlu olarak g\u00f6r\u00fclen b\u00f6lgeler yeniden d\u00fczenlenerek kente farkl\u0131 bir hava getirilecek bu b\u00f6lgeler canland\u0131r\u0131lacak \u00e7a\u011fda\u015f ve soylu bir g\u00f6r\u00fcn\u00fcm kazanacakt\u0131r.<\/p>\n<p style=\"font-weight: 400;\">Kentsel d\u00f6n\u00fc\u015f\u00fcm sadece yeni binalar yapmak de\u011fildir, ayn\u0131 zamanda kent yenileme canland\u0131rma ve soylula\u015ft\u0131rma cal\u0131\u015fmalar\u0131n\u0131 da i\u00e7ermektedir. \u00dclkemizde kentsel d\u00f6n\u00fc\u015f\u00fcm \u00e7al\u0131\u015fmalar\u0131 Avrupa ve D\u00fcnya&#8217;ya g\u00f6re ge\u00e7 ba\u015flam\u0131\u015ft\u0131r. \u00dclkemizde ilk kentsel d\u00f6n\u00fc\u015f\u00fcm \u00e7al\u0131\u015fmalar\u0131 1980 sonlar\u0131nda Ankara&#8217;da Dikmen Vadisi Kentsel Geli\u015fim Projesi olarak yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"font-weight: 400;\">\u00c7al\u0131\u015fmam\u0131z be\u015f b\u00f6l\u00fcmden olu\u015fmaktad\u0131r. ilk b\u00f6l\u00fcmde kentsel d\u00f6n\u00fc\u015f\u00fcm kavram\u0131, geli\u015fimi ve ama\u00e7lar\u0131 \u00fczerinde durulacakt\u0131r. \u0130kinci b\u00f6l\u00fcmde, kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn kapsam\u0131, kentsel d\u00f6n\u00fc\u015f\u00fcm t\u00fcrleri, bitirilen devam eden ve planlanan projeler ele al\u0131nacakt\u0131r. \u00dc\u00e7\u00fcnc\u00fc b\u00f6l\u00fcmde ise kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn yasal dayanaklar\u0131 ele al\u0131nacakt\u0131r. D\u00f6rd\u00fcnc\u00fc b\u00f6l\u00fcmde kentsel d\u00f6n\u00fc\u015f\u00fcm olumlu ve olumsuz y\u00f6nlerine ve deprem ger\u00e7e\u011fine de\u011finilecektir. Son b\u00f6l\u00fcmde sonu\u00e7 ve de\u011ferlendirme olarak kurgulanm\u0131\u015ft\u0131r.<\/p>\n<p style=\"font-weight: 400;\"><b><strong>KENTSEL D\u00d6N\u00dc\u015e\u00dcM\u00dcN KAPSAMI, T\u00dcRLER\u0130, B\u0130T\u0130R\u0130LEN DEVAM EDEN VE PLANLANAN PROJELER<\/strong><\/b><\/p>\n<p>&nbsp;<\/p>\n<p style=\"font-weight: 400;\">5393 say\u0131l\u0131 Belediye Kanunun 73. Maddesinde kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131 olarak ilan edilebilmesi i\u00e7in o yerin belediye veya m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7erisinde \u00a0bulunmas\u0131 ve en az 50.000 m\u00b2 olmas\u0131 \u015fart\u0131 aran\u0131r. \u00a0Bunu yan\u0131nda, kentin geli\u015fimine uygun olarak y\u0131pranan ve eskiyen alanlar\u0131n yeniden in\u015fas\u0131 ve restore edilmesiyle yeni konut, sanayi ve ticari alanlar\u0131, teknoloji parklar\u0131, sosyal donat\u0131lar olu\u015fturmak, deprem riskine kar\u015f\u0131 \u00f6nlem almak, tarihi-k\u00fclt\u00fcrel dokuyu korumak i\u00e7in d\u00f6n\u00fc\u015f\u00fcm projeleri uygulayabilece\u011fi belirtilmektedir. Eskiyen kent par\u00e7alar\u0131n\u0131n, d\u00f6n\u00fc\u015f\u00fcme konu olacak alanlar\u0131n hangi \u00f6l\u00e7\u00fcte g\u00f6re ve kim taraf\u0131ndan bu kapsama girece\u011fine dair bir h\u00fck\u00fcm getirilmemektedir. 5366 say\u0131l\u0131 yasa ile y\u0131pranan ve \u00f6zelli\u011fini kaybeden alanlar\u0131n hangi \u00f6l\u00e7\u00fctlere g\u00f6re belirlenece\u011finin bilinmemesi kentsel sit alanlar\u0131n\u0131n yenileme alan\u0131 ilan edilmesini kolayla\u015ft\u0131racak, korumay\u0131 engelleyecektir (S\u00f6nmez, \u015eanl\u0131, 2010:67).<\/p>\n<p style=\"font-weight: 400;\">Kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn bir kentsel yenileme modeli olarak \u00fclkemizde en yayg\u0131n kullan\u0131m\u0131, gecekondu alanlar\u0131n\u0131n yeniden yap\u0131lanmas\u0131d\u0131r (D\u00fcndar, 2006:65-74). Kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 genellikle kullan\u0131lamaz hale gelmi\u015f, tarihi dokusunu yitirmi\u015f, \u00e7\u00f6k\u00fcnt\u00fc alanlar\u0131 ve \u0131slah &#8211; imar planlar\u0131 ile d\u00f6n\u00fc\u015f\u00fcm\u00fc ger\u00e7ekle\u015fmemi\u015f gecekondu alanlar\u0131n\u0131n d\u00fczenlenmesi ve kullan\u0131l\u0131r hale getirilmesi olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Ancak, 1980\u2019li y\u0131llarda izlenen liberal ekonomik politikalarla \u00fclkemiz g\u00fcndemine giren kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131, \u0131slah-imar planlar\u0131 tek alternatif g\u00f6r\u00fclerek ve kamu \u00f6zel sekt\u00f6r i\u015fbirli\u011fi ile kat\u0131l\u0131mc\u0131 s\u00f6ylemle geli\u015ftirilerek artm\u0131\u015f, d\u00f6n\u00fc\u015f\u00fcm h\u0131zlanm\u0131\u015ft\u0131r (Uluda\u011f ve \u00d6zer, 2006:35\u201342).<\/p>\n<p style=\"font-weight: 400;\">Kentsel d\u00f6n\u00fc\u015f\u00fcm ba\u015fta a\u015f\u0131r\u0131 g\u00f6\u00e7 alan Ankara, \u0130stanbul ve \u0130zmir gibi metropollerimizin \u00e7evresini bir halka gibi saran gecekondu b\u00f6lgelerinde yap\u0131lacak yenileme ve geli\u015ftirme \u00e7al\u0131\u015fmalar\u0131, kentlere canl\u0131l\u0131k kazand\u0131raca\u011f\u0131 gibi ekonomik sosyal ve k\u00fclt\u00fcrel sorunlara da \u00e7\u00f6z\u00fcm getirecek \u00f6nlemler paketi olabilecek \u00e7al\u0131\u015fmalard\u0131r.<\/p>\n<p style=\"font-weight: 400;\">K\u00fclt\u00fcr miras\u0131 a\u00e7\u0131s\u0131ndan zengin, ancak \u00e7e\u015fitli nedenlerle bo\u015f ve bak\u0131ms\u0131z b\u0131rak\u0131larak kaderine terk edilmi\u015f, yanl\u0131\u015f ve zarar verecek \u015fekilde kullan\u0131larak tahrip edilmi\u015f, i\u00e7inde sonradan ya\u015fanmaya ba\u015flanm\u0131\u015f ve de\u011fi\u015ftirilmi\u015f yap\u0131 gruplar\u0131ndan olu\u015fan eski kent par\u00e7alar\u0131, etraflar\u0131ndaki kalitesiz \u00e7evre \u00f6zellikleri ile kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn zorunlu oldu\u011fu alanlard\u0131r. Ekonomik geli\u015fmelere dayanmaya \u00e7al\u0131\u015fan eski kent par\u00e7alar\u0131n\u0131n \u0131slah\u0131 ve yeniden i\u015flevlendirilmesi sonucu yenilenerek sa\u011fl\u0131kl\u0131 bir kentsel \u00e7evre yarat\u0131lmaya \u00e7al\u0131\u015f\u0131l\u0131rken, plans\u0131z geli\u015fen kent par\u00e7alar\u0131n\u0131n da kontrol alt\u0131na al\u0131nmas\u0131 ve yeniden olu\u015fturulmas\u0131 sa\u011flanmal\u0131d\u0131r (\u00d6zden, 2001:4).<\/p>\n<p style=\"font-weight: 400;\">Anayasa\u2019m\u0131z\u0131n 56. maddesi ile halka tan\u0131nan sa\u011fl\u0131kl\u0131 ve dengeli bir \u00e7evrede ya\u015fama hakk\u0131n\u0131n ger\u00e7ekle\u015ftirilmesinde kentsel d\u00f6n\u00fc\u015f\u00fcm projelerine ve bunu ger\u00e7ekle\u015ftirecek yerel y\u00f6netimlere d\u00fc\u015fen g\u00f6rev \u00e7er\u00e7evesinde \u00f6rg\u00fct \u015femalar\u0131n\u0131n olu\u015fturulmas\u0131, bunlar\u0131n ger\u00e7ekle\u015ftirilmesi i\u00e7in gerekli finansal olanaklar\u0131n ve kat\u0131l\u0131m\u0131n sa\u011flanmas\u0131d\u0131r. Kentsel d\u00f6n\u00fc\u015f\u00fcm, bir stratejiler b\u00fct\u00fcn\u00fc dahilinde ger\u00e7ekle\u015ftirilebilecek s\u00fcre\u00e7 i\u00e7erisinde yerel y\u00f6netimler kentsel d\u00f6n\u00fc\u015f\u00fcm projelerinin sorumlusu durumundad\u0131r. Kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn daha sa\u011fl\u0131kl\u0131 ve gelece\u011fe y\u00f6nelik olabilmesi i\u00e7in yerel y\u00f6netimler d\u00f6n\u00fc\u015f\u00fcm projeleri olu\u015fturma g\u00f6revlerini, alan\u0131n fizik &#8211; mekansal, ekonomik ve sosyo &#8211; k\u00fclt\u00fcrel niteliklerine g\u00f6re farkl\u0131 kurum ve kurulu\u015flarla payla\u015farak ger\u00e7ekle\u015ftirmelidirler. Yerel y\u00f6netimler, kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn, gerek karar alma s\u00fcrecinde, gerekse uygulama safhalar\u0131nda, kentsel k\u00fclt\u00fcr miras\u0131n\u0131 korumak ve g\u00f6zetmek \u00fczere, uzman\u0131ndan y\u00f6netime, meslek odalar\u0131 temsilcileri ve \u00f6zel \u015fah\u0131slara dek uzanan \u201cDan\u0131\u015fma Kurulu\u201d niteli\u011finde bir kat\u0131l\u0131m grubu ile i\u015fbirli\u011fi i\u00e7inde \u00e7al\u0131\u015fmal\u0131, onlar\u0131n g\u00f6r\u00fc\u015fleri do\u011frultusunda hareket etmelidirler (Kaptan, 1981:83).<\/p>\n<p style=\"font-weight: 400;\"><b><strong><br \/>\nKentsel D\u00f6n\u00fc\u015f\u00fcm T\u00fcrleri<\/strong><\/b><\/p>\n<p style=\"font-weight: 400;\">Kentsel D\u00f6n\u00fc\u015f\u00fcm T\u00fcrlerini yap\u0131l\u0131\u015f bi\u00e7imlerine g\u00f6re d\u00f6rt ba\u015fl\u0131k alt\u0131nda toplayabiliriz.<\/p>\n<p style=\"font-weight: 400;\"><b><strong>KENTSEL D\u00d6N\u00dc\u015e\u00dcM\u00dcN YASAL DAYANAKLARI<\/strong><\/b><\/p>\n<p>&nbsp;<\/p>\n<p style=\"font-weight: 400;\">Anayasa\u2019n\u0131n, 56. maddesi; \u201cherkesin sa\u011fl\u0131kl\u0131 ve dengeli bir \u00e7evrede ya\u015fama hakk\u0131na sahip oldu\u011fu ve \u00e7evreyi geli\u015ftirmenin devletin ve vatanda\u015flar\u0131n \u00f6devi oldu\u011funu\u201d,57. maddesi; \u201cdevletin, \u015fehirlerin \u00f6zelliklerini ve \u00e7evre \u015fartlar\u0131n\u0131 g\u00f6zeten bir planlama \u00e7er\u00e7evesinde konut ihtiyac\u0131n\u0131 kar\u015f\u0131layacak tedbirleri almakla y\u00fck\u00fcml\u00fc oldu\u011funu\u201d belirtmektedir. Kentse D\u00f6n\u00fc\u015f\u00fcmle Programlar\u0131 ve projeleriyle ilgili eksik de olsa yasal konular\u0131n g\u00f6zden ge\u00e7irildi\u011fi, eksik g\u00f6r\u00fclen noktalar\u0131n giderilmeye \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131 \u00f6zellikle 2003\u2032ten bu yana bir \u00e7ok de\u011fi\u015fikli\u011fe gidildi\u011fi g\u00f6zlemlenmektedir. Kentsel d\u00f6n\u00fc\u015f\u00fcm, anayasa yapmak kadar \u00f6nemlidir; \u00e7\u00fcnk\u00fc sonu\u00e7lar\u0131 itibariyle en az anayasa kadar hayat\u0131m\u0131z\u0131 etkiler. T\u00fcrkiye\u2019de \u015fehirle\u015fmede altyap\u0131, ula\u015f\u0131m, sosyal donat\u0131 alanlar\u0131, bina kalitesi ve depremlerden dolay\u0131 ciddi \u015fehirle\u015fme sorunlar\u0131 ya\u015fanmaktad\u0131r. Halk\u0131m\u0131z\u0131 daha sa\u011fl\u0131kl\u0131, g\u00fcvenli ve huzurlu \u015fehirlerde yerle\u015ftirmek i\u00e7in gerekli \u00e7al\u0131\u015fmalar\u0131n yap\u0131lmas\u0131 gerekmektedir. B\u00fcy\u00fck k\u00fc\u00e7\u00fck bir\u00e7ok \u015fehrimiz benzer sorunlarla kar\u015f\u0131 kar\u015f\u0131yad\u0131r ve ya\u015fam kalitesi her ge\u00e7en g\u00fcn d\u00fc\u015fmekte ve insanlar\u0131m\u0131z i\u00e7in \u015fehirde hayat \u00e7ekilmez hale gelmektedir.<\/p>\n<p style=\"font-weight: 400;\">Deprem ger\u00e7e\u011fi de \u00f6n\u00fcm\u00fczde durmaktad\u0131r. \u00dclkemizin sosyal bar\u0131\u015f\u0131n\u0131 sa\u011flayacak, ekonomimizi \u00e7al\u0131\u015ft\u0131racak, daha sa\u011fl\u0131kl\u0131, s\u00fcrd\u00fcr\u00fclebilir ve ya\u015fanabilir bir \u015fehircilik i\u00e7in deprem ve afet ger\u00e7e\u011fini unutmamal\u0131y\u0131z. Bunu yaparken kendi \u015fehircilik miras\u0131m\u0131z ve d\u00fcnyan\u0131n geldi\u011fi \u015fehircilik anlay\u0131\u015f\u0131ndan yararlanmal\u0131y\u0131z.
